ATV and Buggy Tourist Terms and Conditions

1. Introduction

These Terms and Conditions ("Agreement") govern the relationship between ATV and Buggy ("Company") and tourists ("User" or "You") who book and participate in desert safari rides. By booking a ride through our website or mobile application, you agree to abide by these terms.

2. Definitions

  • ● Company: ATV and Buggy, a desert safari adventure service provider.
  • ● User: A person who books a ride through the ATV and Buggy platform.
  • ● Private Ride: A booking where a tourist is picked up from their specified address.
  • ● Group Ride: A booking where tourists are picked up from a designated location provided by the Company.
  • ● QR Code: A unique code generated upon booking, used for ride verification.
  • ● CRM: The system used to manage customer interactions and ride logistics.
  • ● Representative: A Company staff member responsible for ride coordination.
  • ● Driver: The designated individual responsible for conducting the ride.

3. Booking & Confirmation

  • ● Users can book rides for 30, 60, 120, or 180 minutes through the website or mobile application.
  • ● Available ride slots are displayed on the platform for selection.
  • ● Upon successful booking, the user receives a QR Code via email, which is required for ride verification.
  • ● Users can log in to the Tourist App with the same credentials used on the website to view their bookings.
  • ● Coupon codes and promotional discounts may be applied at least 3 hours before the ride and cannot be added post-booking.

4. Ride Flow & Experience

  • ● The driver receives a notification upon booking confirmation and must pick up and drop off the user 3 hours prior to the ride.
  • ● Upon arrival at the desert location, the driver scans the user’s QR code to start the ride.
  • ● The representative scans the user’s QR code and assigns the tourist their vehicle.
  • ● If the user is unsatisfied with the assigned vehicle, they may request a change:
    • ○ If a similar category vehicle is available, it will be provided.
    • ○ If not available, a higher-category vehicle may be offered at no extra cost.
    • ○ If neither option is satisfactory, a partial refund will be issued.

5. Cancellation & Refund Policy

  • ● Users may cancel a booked ride at least 48 hours before the scheduled time to receive a full refund.
  • ● Cancellations made within 48 hours will not be eligible for a refund.
  • ● If a driver is unavailable, a broadcast message is sent to other online drivers. If no driver accepts, ATV and Buggy will assign another driver or issue a refund.

6. Safety Measures

  • ● Seat Belts: It is mandatory for all passengers to wear seat belts while the vehicle is in motion.
  • ● In-Car Safety Equipment: Vehicles must be equipped with necessary safety equipment as per regulatory standards.

7. Licensing and Vehicle Registration

  • ● Driver Certification: All drivers must possess a valid tour guide certification from Dubai Tourism and the necessary licenses from the Dubai Roads and Transport Authority (RTA).
  • ● Vehicle Registration: All vehicles used for desert safaris must be registered with the appropriate authorities.

8. Consumer Protection

  • ● Clear Pricing: All services must have clearly displayed and legible prices.
  • ● Refund Policy: In case of service dissatisfaction, consumers have the right to seek compensation or refunds.
  • ● Data Protection: Consumers' personal information must be protected, and their privacy respected in compliance with UAE laws.

9. Environmental Responsibility

  • ● Sustainability Practices: Operators are encouraged to adopt eco-friendly practices to preserve the desert environment.

10. Insurance and Liability

  • ● Comprehensive Insurance: Operators must provide comprehensive insurance coverage for all vehicles and passengers.
  • ● Liability: In case of an accident or vehicle damage, the driver is solely responsible, and the Company holds no liability.

11. Age Restrictions

  • ● Certain activities may have age restrictions to ensure safety; these should be clearly communicated to consumers.

12. Pickup & Drop-off Policy

  • ● Private Ride Users: Eligible for pickup from their home location.
  • ● Group Ride Users: Must be picked up from the designated location provided by the Company.

13. Driver & Ride Management

  • ● Drivers receive notifications when a booking is made and must confirm availability.
  • ● If a driver needs to cancel a ride, they must provide at least 2 hours’ notice.
  • ● If a driver is unavailable, they can send a broadcast message for assistance. If no other driver accepts, the notification will escalate to ATV and Buggy management.

14. Cancellation and Force Majeure

  • ● Operator's Right to Cancel: The company reserves the right to postpone or cancel any trip prior to departure due to unforeseen circumstances such as weather conditions, illness, strikes, conflicts, or other force majeure incidents.

15. User Account & Deactivation

  • ● Users may deactivate their account at any time via the platform.
  • ● The Company reserves the right to deactivate a user’s account if suspicious or fraudulent activity is detected.

16. Governing Law & Jurisdiction

  • ● These Terms and Conditions comply with UAE Desert Safari Tourism Regulations and Consumer Protection Laws.
  • ● Any disputes shall be settled under UAE law in a competent court in Dubai.
